The report is from the district Shahjahanpur of Uttar Pradesh where a victim of rape has written a letter to the President and district judge about a 7-year-old rape case that has recently been withdrawn by the Government of Uttar Pradesh. The Rape case was filed in the year 2011 against the then union minister Chinmayanand. In her letter, the woman has raised objections against this move of the state government and has asked the President to immediately issue an arrest warrant against the accused.
As per our sources, the government had sent a letter to the district administration regarding the withdrawal of this case on March 6th and taking action on this letter, the district administration of Shahjahanpur wrote to the prosecution officer of this case for withdrawal of the case on March 9th. Mr Sarvesh Dixit, Additional District Magistrate of Shahjahanpur, informed that the district administration has decided to withdraw the case in the Kotwali Police Station under the sections 376 and 506 of the Indian Penal Code. In her letter to the president, the victim also states that the decision of the withdrawal of the pending case has been taken after the current Chief Minister of the Uttar Pradesh had visited the Accused for a Lunch on February 25th, 2018.
The FIR in the case was lodged on November 30th, 2011 against the former union minister when a girl who had spent several years in his ashram accused him of raping her. In her father’s FIR at Kotwali Police Station, it has been mentioned that the girl was kidnapped and kept in Chinmayanand’s Haridwar ashram where she was raped by Chinmayanand himself. After the district court gave a decision in favour of the victim, the arrest of Chinmayanand was stayed when he moved to the high court to appeal against the verdict of District Court. The Case has been pending in the high court since then. But now, as the District Administration has withdrawn the case themselves, there won’t be any hearing on this case in High Court and the accused will roam freely without even having to appear in the court.
The Voice Raiser condemns this action of the state government that has prevented justice to a rape victim. The Indian Judicial System already has been under questions by social justice organizations and now such cases are arriving one after another where the justice hasn’t been given to the victim. We have recently seen the case of Salman Khan where he got a bail from the jail within two days of the decision of the high court. He was able to do so by appealing high court’s decision in the Supreme Court. In the same way, Swami Chinmayanand had allegedly misused the Indian Judicial System by challenging district court’s decision in the high court where the case has been pending since past 6 years and now ultimately withdrawn by the influence of the state government.
